Prosecution of Offences against the Surveying Act 2004: Stelian Theodoreskou
On 8 June 2022, an unlicensed surveyor, Mr Stelian Theodoreskou, pleaded guilty to five charges relating to offences against s.35(1)(b) and s.35(1)(c) of the Surveying Act 2004.
Under the Surveying Act 2004:
- A person who is not registered as a licensed surveyor must not claim to be registered or hold himself or herself out as being registered [s.35(1)(b)]
- A person who is not registered as a licensed surveyor must not carry out any act which is required to be carried out by a licensed surveyor [s.35(1)(c)]
The surveys were conducted in Northcote, Rowville, Carlton, Maidstone, and Heidelberg Heights.
Mr Theodoreskou was, without conviction, fined $5000 as part of an aggregate order and also ordered to pay costs in the amount of $4926.73.
